We have downloaded version 4.4 EVRC-B fixed point code from

While running the decoder in DTX (9_3.o22 and 5_8.o22 outputs for
9_3.p22 and 5_8.p22 resp) are not passing.
I would highly appreciate if anyone having information on these issues of this
code could help me out.

Looks like there is some problem with the reference code. As EVRC-B fixed point reference code is not yet stabilized, you can expect this kind of surprises.
I have come across couple issues with earlier versions of the reference code.

1)MOT_SUPPRESSED_EIGHTHRATE
2)DTX
Default DTX will be enable that will be in globs_fx.h file
If we are run the streams in MOT_SUPPRESSED_EIGHTHRATE(that is a macro)
All streams are passing.
But if we enable DTX two of the streams are not passing.
Are you clear with these details?

Looks like there is some problem with the reference code. As EVRC-B fixed point reference code is not yet stabilized, you can expect this kind of surprises.
